This website is operated by Peak Origin. These Terms of Service (“Terms”) govern your access to our website and your purchase or use of our products and services. By using the website or placing an order, you agree to these Terms and our Return and Refund, Privacy, Shipping, and Subscription policies. If you do not agree, do not use the store.

Eligibility and acceptable use

You must be at least the age of majority in your province, state, or territory and legally capable of entering a contract. You must not misuse the website, interfere with security, introduce malicious code, scrape the store without permission, violate law, infringe rights, or use our services for unlawful or unauthorized purposes.

Wellness products and health information

Our products are not a substitute for medical advice, diagnosis, or treatment. Read and follow the product label, directions, warnings, ingredient list, recommended use, and storage instructions. We may correct errors, update information, limit quantities, refuse or cancel orders, or discontinue products, subject to applicable law. If we cancel a paid order, we will refund the cancelled amount.

Orders, billing, and taxes

An order is an offer to purchase and is accepted when we confirm acceptance or fulfill it. You must provide current, complete, and accurate billing, contact, and delivery information and be authorized to use the payment method. Prices are shown in the currency displayed at checkout. Applicable taxes, shipping charges, duties, and other disclosed charges are added at checkout.

Subscriptions

When you choose a subscription, you authorize recurring monthly charges for the price, quantity, taxes, and any shipping shown or disclosed at checkout until cancellation. Subscription terms, cancellation timing, price changes, and refund eligibility are described in our Purchase Options Cancellation Policy, which forms part of these Terms.

Shipping, returns, and risk

Processing and delivery estimates, third-party fulfillment disclosures, customs responsibilities, and delivery issues are governed by our Shipping Policy. Returns, defects, refunds, and order-cancellation requests are governed by our Return and Refund Policy. Nothing in these policies limits non-waivable consumer rights.

Intellectual property

The website and its text, graphics, logos, photographs, product presentation, software, and other content are owned by or licensed to Peak Origin and protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping only. No licence is granted except as necessary for that use.

Third-party services and links

Shopify and other third parties provide hosting, payments, subscriptions, shipping, analytics, and related services. Third-party websites and services are governed by their own terms and privacy practices. We are not responsible for third-party content or services except to the extent required by law.

Disclaimer and limitation of liability

To the maximum extent permitted by law, the website and its content are provided on an “as available” basis without warranties not expressly stated in these Terms. Peak Origin is not liable for indirect, incidental, special, punitive, or consequential losses, lost profits, or lost data arising from use of the website or products where such exclusion is lawful. Where liability cannot lawfully be excluded, it is limited only to the extent permitted by law. These limitations do not apply to liability that cannot be limited, including applicable statutory consumer rights.

Indemnity

To the extent permitted by law, you agree to indemnify Peak Origin for third-party claims and reasonable costs resulting from your unlawful misuse of the website, violation of these Terms, or infringement of another person’s rights. This does not apply to claims caused by our own breach, negligence, or wrongdoing.

Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without depriving consumers of mandatory protections in their home jurisdiction. Before starting formal proceedings, please contact us so we can try to resolve the issue. Subject to mandatory law, disputes shall be brought before courts with jurisdiction in Ontario.

General

If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. We may update these Terms prospectively by posting a revised version. The policies referenced above and information confirmed at checkout form part of the agreement.
